Nothing contained in this document is intended to effect or restrict the statutory rights of a consumer.

General
This document contains all the terms of the contract and no amendment here to shall be valid unless agreed in writing by an authorized official of the vendor. These conditions shall apply to all dealings by Tokyo Express (The vendor) and any contract and arrangement between the vendor and purchaser whether in accordance with a quotation or any order of the purchaser which is accepted by the vendor is subject to these conditions which shall govern any contract to the exclusion of any other terms and conditions.
These terms shall be treated or deemed to have been delivered first and last in time and accepted by the purchase.

Price
The price is as agreed on the receipt of the quote from the vendor
Specifications.
All items are supplied to the specification given by the consumer and products are supplied relying on the fact that all information given is as accurate as possible.

Delivery
The vendor will use all reasonable efforts to meet delivery dates agreed however where an estimated cannot be met the vendor shall use every effort to inform the consumer and give reasons for such delay.

Payment
Unless otherwise agreed the consumer shall make payment for products prior to them receiving delivery of the items.

Property
The goods shall remain the property of the vendor until the total purchase price has been discharged in full.  A cheque given by the purchaser in payment shall not be treated as a discharge until the same has been cleared.  A bank transfer by the purchaser in payment shall not be treated as a discharge until the funds have fully cleared the bank account.

Product Guarantee/Warranty
Any warranty supplied to the consumer on any product purchased will be that which is supplied by the manufacturer of the product.
No condition is made or to be implied nor is any warranty given or to be implied other than the manufactures, or that the products supplied will be suitable for any particular purpose. We disclaim any responsibility for products which do not reach the normal manufactures standards, or any damages which are incurred directly or indirectly on the vehicles or operators or passengers of the vehicle.

Returns
Goods purchased by mail order that prove unsuitable may be returned for refund, credit or exchange if they are returned to the Company within 7 days of receipt, subject to the following conditions.
Items are returned carriage paid, unused and in their original condition to secure a refund. Items must be returned complete with all packaging in good condition. The Company is not obliged to make any offer to refund credit or exchange goods if received outside the 7-day period. Items not returned within 7 days will be subject to a re – stocking fee of not less than 15% (this does not affect statutory rights) should the Company agree to accept the goods. We cannot accept for return non - stock / special order items once supplied unless there is a specific manufacturing defect. We cannot accept responsibility for returned goods which are undelivered, retain your proof of postage for use in the event of any claim. The Company is not responsible for any costs incurred during fitting or removal of any allegedly faulty (or incorrectly supplied) goods (see ‘property’). To offset the cost of order processing, the Purchaser will be charged a handling fee in accordance with costs incurred by the Company on all returned goods unless the Company accepts liability for any unsuitable or faulty item. An amount no greater than 25% of the original purchase price will be applied.

Incorrect Items
Any Incorrect items will be replaced as soon as possible, Please notify us of any problem, and reseal the parcel ready to send back. All return items must be in original packaging and in new, saleable condition.

Performance products
The consumer understands the ramifications of buying and installing these performance parts to their vehicle. The vendor is not responsible for any misconception or disappointment associated with the parts purchased.

Copyright and intellectual property rights.
All Copyright design right and any other right in the nature of intellectual property rights in any data or pictures prepared for the purchaser shall be and remain the absolute property of the vendor.

Liability
The liability of the vendor either to the purchaser or any other person or company for damage injury or loss or any kind what so ever to any property or person arising on consequence of having purchased or possessed the sellers goods or for any consequential loss shall be limited to the replacement value of said goods.
For the avoidance of doubt the vendor shall not in any event how so ever or what so ever be responsible or have and consequential.
